Members of Chambers have transferred their considerable expertise acquired over many years in cases involving the High Court's inherent jurisdiction to the newer jurisdiction of the Court of Protection and regularly appear up and down the country, often before the High Court judges hearing the more difficult cases.
We represent Local Authorities, family members and other public bodies and provide expert advice at the pre-litigation stages.
Mental Capacity - an individual’s ability to make his/her own decisions – may be in issue for a host of reasons, including:
- Alzheimer’s, Dementia or other degenerative disease,
- Terminal illness / catastrophic injury
- Brain Damage, traumatic or organic,
- Learning disabilities,
- Autism or Asperger’s,
- Other mental health conditions, whether permanent or transient.
Each case can pose great difficulties to those involved: logistical, management and funding difficulties for the responsible Local Authority or PCT, and huge emotional pressures for close family, often feeling sidelined. Chambers recognises the particular clarity of thought, expertise and sensitivity needed to provide effective representation.
The regulation of the Deprivation of Liberty both in court and under the administrative Safeguards system is integral to much of our work, both in court and when advising the various interested parties.
Members of Chambers act in cases involving issues around Welfare, the administration of a person’s affairs and estate, Deputyship (whether Financial or otherwise), and the enforced provision or authorised withdrawal of medical treatment.
Chambers runs an acclaimed regime of internal training as well as offering external training to Local Authorities (lawyers and social workers), solicitors and other interested bodies. (Any enquiries in respect of this training, please, to one of the Clerks.
